What Happened

On a foggy morning in May 2020, our client was driving to work near Blackiston when a trooper turned left into his path. He swerved and hit a second trooper’s car that was following close behind. Neither trooper had lights or sirens on.

How We Built the Case

Our attorneys brought in a police practices expert, who found that the troopers were not responding to an emergency and that one was driving as fast as 86 mph in the fog. The case settled in 2025 as trial approached. As attorney Gary Nitsche told the paper, “He had a good lawyer.”

Can You Sue After a Crash With a Police Vehicle?

Often, yes. Police can exceed the speed limit during an emergency, but only if they do not endanger life or property (21 Del. C. § 4106). The State of Delaware also insures its vehicles, which can open the door to a claim. These cases are complex, so it helps to have an experienced attorney on your side.
